Chapter 13 bankruptcy is sometimes called a “reorganization” or a “wage-earner plan.” If you are behind on house or car payments, a Chapter 13 bankruptcy generally allows you to pay off the “arrearages,” or what sum of money you are behind, over the plan period, usually 36 to 60 months. Many people who are behind on their house payments find that a Chapter 13 may be the only solution to saving their house.
A main thrust of the new bankruptcy laws is to encourage more people to file for bankruptcy under Chapter 13, instead of wiping out their debts completely under Chapter 7 bankruptcy. Chapter 13 is mostly used under circumstances where an individual makes too much money to file a Chapter 7 or where an individual is behind on home mortgage or car payments. The new law creates a financial means test to determine if you qualify for Chapter 7 or if you must file under Chapter 13. Most people filing for Chapter 13 protection are hard working people, even two-income families, whose monthly income enables them to pay some but not all of their monthly obligations. Under a Chapter 13 bankruptcy plan, the bankruptcy court approves a plan submitted by you which allows you to make monthly payments on your debts over a period of 36 to 60 months. The amount you pay is often a small percentage of your total debt or even pennies on the dollar, depending on particular finances. At the end of plan period, the remaining debts are discharged, or eliminated.
